1. Acceptance of Terms

By downloading, installing, or using the GroupChatAI application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Description of Service

GroupChatAI provides simulated group chat experiences with AI-powered characters. Users can:

  • Engage in one-on-one and group conversations with AI characters
  • Build friendships and relationships with AI characters
  • Participate in virtual events and interactive narratives with AI characters
  • Generate AI-powered images based on conversations and events
  • Sync data across devices with cloud sync

3. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. User Conduct

You agree not to use the app to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others
  • Distribute malware or harmful code
  • Attempt to gain unauthorized access to our systems
  • Use the service for any illegal purpose
  • Interfere with or disrupt the service
  • Attempt to manipulate AI characters to generate harmful or illegal content
  • Impersonate any person or entity
  • Collect user data without authorization

5. AI-Generated Content

You acknowledge that:

  • All character responses, event narratives, and images are generated by AI
  • AI-generated content may not always be accurate or appropriate
  • Characters are entirely fictional and do not represent real individuals
  • AI-generated images depict fictional scenes and do not portray real people
  • AI responses do not constitute professional advice of any kind
  • Relationships with AI characters are simulated and not real interpersonal relationships

6. Subscriptions and Payments

  • Some features require an active subscription
  • Subscriptions are billed according to the plan selected
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
  • Refunds are handled by Apple according to their refund policies
  • We reserve the right to change pricing with reasonable notice
  • Free tier users have limited access to AI messaging and image generation

7. Intellectual Property

All content, features, and functionality of the app are owned by GroupChatAI and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive license to use the app for personal, non-commercial purposes.

8. User Content

You retain ownership of content you create within the app (messages, profile information). By using the service, you grant us a license to store and process your content solely for the purpose of providing the service. AI-generated content (character responses, images, event narratives) is provided for your personal use within the app.

9. Privacy

Your use of the app is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

The app is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, appropriate, or free from errors.

11. Limitation of Liability

In no event shall GroupChatAI be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from AI-generated content. Our total liability shall not exceed the amount you have paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless GroupChatAI from any claims, damages, losses, or expenses arising from your use of the app or violation of these Terms.

13. Termination

We reserve the right to terminate or suspend your access to the app at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users. Upon termination, your right to use the app ceases immediately. You may delete your account at any time from within the app settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the use of the app shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or by other means. Continued use of the app after changes constitutes acceptance of the updated Terms.
